Transport conditions

A boarding pass cannot be exchanged for cash, reimbursed or exchanged.

The Société des traversiers du Québec (hereinafter “STQ”) invites you to read the web page of the ferry used in order to find out in particular the practical information and restrictions regarding the transport of dangerous goods. STQ personnel on board our ships indicate to the Passenger drivers which ramp to take, but the driver of a vehicle must have care and control of his vehicle at all times. Also, fold down your mirrors yourself, the space on board is limited.

You must stay at all times during the crossing near your motorcycle, except on board the NM F.-A.-Gauthier and the NM Saaremaa 1, the STQ being in no way responsible for the fall of the latter.

If you are traveling with a pet, you must keep it on a leash.

In order to preserve air quality, when boarding, start your vehicle at the last minute and switch off the engine as soon as you are parked on board. When disembarking, please wait for the attendant's signal before starting your vehicle.

On disembarking, all Passengers are invited to return to their vehicle to leave the ship.

The captain reserves the right to refuse to embark a passenger and / or his vehicle, if in the captain's opinion this passenger and / or vehicle is likely to constitute a danger for the ship and / or other passengers.

If you or a passenger in your vehicle need assistance in getting around, please let us know when you arrive at the ferry.

No medical personnel are available on board, except first aid which can be provided if necessary. Passengers who present special conditions are invited to take this into consideration and travel at their own risk.

The STQ agrees to transport the Passenger their luggage and / or vehicle to their destination quickly, however the STQ reserves the right, if necessary, to substitute its vessel, to cancel one or more crossings, or to interrupt the service without notice and this, without responsibility, nor recourse for delay or interruption of service.

The STQ cannot guarantee that service modification alerts will be launched in a timely manner. In addition, it is the passengers' responsibility to subscribe to alerts and to follow those concerning the sleepers used in order to be notified of exceptional situations beyond the control of the STQ, and which are likely not to be restored from imminently.

Smoking is prohibited in our stations and on board our ships, including the outer decks of ships, outside the areas clearly identified for this purpose. It is strictly forbidden for any Passenger to consume alcohol, except inside the bar and the bistro on board the NM F.-A.-Gauthier. It is also strictly forbidden for any Passenger to use drugs, cannabis, or to be under their residual effect.

Conditions of use of the accessible services from the website

Société des traversiers du Québec (STQ) operates the Web site www.traversiers.com, hereinafter called the “site”. Use of the services accessible through the site is governed by these terms and conditions of use, which constitute a contract between the user and STQ. Users who accept these terms and conditions shall comply with the provisions herein and abide by all applicable laws and regulations.

Exemption from liability

The Passenger and any accompanying person, if any, and the Société des traversiers du Québec (STQ), its administrators, officers, employees, agents or subcontractors, agree as follows.

The STQ benefits from exemptions and limitations of liability under the Marine Liability Act (SC 2001, c. 6) and any subsequent amendment (the Act) for any bodily, psychological or material damage, including death and injuries. personal injury and loss or damage to any vehicle and baggage. The STQ will only be held liable after deducting the deductibles provided for in the Act, that is, 135 account units per passenger for loss or damage to any baggage and 300 account units for damage caused to a vehicle (approximately $ 206 and $ 457 respectively, approximate value in November 2012).

The STQ is not responsible for loss or damage to cash, negotiable instruments, gold, silverware, fine jewelry, jewelry, works of art or other property of value, unless these valuables have been deposited with the STQ which has agreed to keep them safe.

The Passenger must notify the STQ in writing, before or during disembarkation, of any apparent damage caused to luggage or vehicles. In the event of non-apparent damage to luggage or vehicles, or loss of luggage, the Passenger must notify the STQ, in writing, within fifteen days of disembarking. Failure to notify the STQ in this way, the Passenger is presumed to have received their luggage in good condition.

The Passenger accompanying the child, the elderly or the disabled person is responsible for their movements and acts in all places.

Schedules are subject to change without notice, and without liability, or recourse for delay or interruption of service. Passengers are responsible for all costs associated with these changes.

Applicable laws

The laws applicable in Quebec shall govern any legal dispute arising from these terms and conditions of use and from any use of the site, as well as any contentious proceedings resulting therefrom. The parties hereby elect domicile in the judicial district of Quebec City.

Amendments

STQ reserves the right, at any time and at its sole discretion, to modify or suspend the services offered on the site without prior notice. Furthermore, STQ reserves the right to make any amendments to these terms and conditions of use.

Waiver of liability

STQ and its officers, directors and employees shall not be held liable to any user or third party, either contractually or extra-contractually, for any direct, indirect, incidental or punitive damages arising from, namely but without limiting the generality of the foregoing, use of the site and the content and services provided therein; interruption of online services or any delays related to the use thereof; omission or loss of information or data transmitted; loss of income or profits; damage caused to the user’s computer by a virus or other infection or resulting from incorrect use of online services or use of the site by a third party, regardless of whether STQ was advised of the possibility of such damages.

Users hereby acknowledge that STQ shall not be liable for any monetary damages, regardless of the cause of action, whether contractual or extra-contractual, in excess of the amount of the fees paid by the user with regard to the online services made available on the site.

Password

In order to access online services, users must create an account and choose a password. This password must remain confidential and users, who are solely responsible for preserving the confidential nature of their password, must take all necessary precautions to ensure this. Users shall therefore be liable for any damage arising from any transactions and operations carried out using their password.

STQ cannot be held liable for any loss or damage resulting from the use or disclosure of a password by a user.

Users are responsible for notifying STQ of any fraudulent use of their account or password.

Transaction security

In order to ensure the security of transactions carried out, STQ uses the payment solutions provided by CT-Payment, Canada’s largest independent payment processing company and exclusive service provider to the Quebec government.

When making online purchases, users can check whether their browser is in secure mode by making sure the URL (Web address) begins with “https ://” as opposed to “http ://”. A padlock icon at the bottom of the browser window will also confirm that secure mode is enabled.

STQ does not guarantee total efficiency or security, since the possibility exists of hackers breaching its servers. Before carrying out any transactions or using their identity to browse the site, users must therefore always be mindful of the possibility of STQ servers being hacked by individuals with malicious intent to use personal information provided by users for their own purposes. The site may experience occasional breakdowns and programming errors may be caused by updates or by events beyond STQ’s control.

IN NO CASE shall STQ or any of its directors or employees be held liable for any acts of computer hacking or blamed for any related loss or damage that may be caused to users of the site.

Use of site content

The content of the site is protected by copyright laws and regulations. Users are not permitted to reproduce, download, publish, modify, distribute or sell the content of the site, or create any derivative works, other than for their own purposes of browsing the Internet.

STQ holds the rights to the domain name www.traversiers.com.

Cancellation

STQ may revoke the access rights associated with a user’s account and password at any time, and for any reason, including non-use of online services and failure to comply with these terms and conditions of use.

Confidentiality

In the event of use of non-secure equipment or failure to comply with the provisions of the Password section herein, STQ cannot ensure the confidential nature of transactions and operations carried out by users.

Withdrawal of online services

STQ may terminate the services offered online though the site at any time and at its sole discretion. STQ shall assume no liability for any damage arising from the withdrawal of online services offered through the site.

User obligations

In using the site, its content and the services offered therein, users must not:

  • contravene these terms and conditions of use;
  • provide false, misleading or inaccurate information;
  • infringe any copyright, trademark or any other intellectual property rights belonging to STQ or a third party;
  • use the site and the services it offers in a fraudulent or abusive manner, or in such a way as to put the site out of commission, overload it or otherwise compromise its proper functioning;
  • upload any virus or other harmful element to the site;
  • violate any applicable laws and regulations;
  • engage in libel, slander, defamation or harassment;
  • sell, resell, rent or exploit any portion of the site, any use of online services, or any access rights, for commercial purposes;
  • manipulate the content of the site;
  • collect, store or use any personal information concerning other users.

No warranty

STQ makes no warranties whatsoever, whether expressed or implied. STQ cannot guarantee that the services offered online will be uninterrupted and that the content is free of errors, and offers no warranty of fitness for a particular purpose or of non-infringement of rights.

Force majeure

Neither STQ nor users may be deemed to be in default of fulfilling their obligations under these terms and conditions of use owing to force majeure.

Entire contract

These terms and conditions constitute the entire agreement entered into by STQ and the user.
